Terms & Conditions

Last updated: October 2026

These Terms & Conditions apply to all services provided by Filmeka Production Limited (“Filmeka”, “we”, “us”), a company registered in Ireland CRO number: 772841, with its registered office at 26 Blackrock, Castlebar, Co. Mayo, Ireland. By requesting a quote, booking us, or using this website, you (“the Client”) agree to these terms.

1. Services

Filmeka provides video production services, including pre-production, filming, post-production, and related services such as crew and equipment hire. The exact scope of each project is set out in the written quote or proposal agreed with the Client.

2. Quotes and Booking

2.1. Quotes are valid for [30] days from the date issued.
2.2. A booking is confirmed when the Client accepts the quote in writing (email is sufficient) and pays the deposit.
2.3. Quotes are based on the information the Client gives us. If the scope changes (extra shoot days, locations, deliverables, or revisions), we will provide an updated quote before doing the additional work.
2.4. Filmeka Production Limited is not currently registered for VAT, so no VAT is charged on our prices. If we become VAT-registered, VAT will be added at the applicable rate to invoices issued after the date of registration, and we will tell the Client in advance where this affects an accepted quote.

3. Payment

3.1. A deposit of [50]% is due on booking. The balance is due [on delivery / within 14 days of invoice].
3.2. Final files are released once payment is received in full.
3.3. Late payments may incur interest under the European Communities (Late Payment in Commercial Transactions) Regulations 2012.
3.4. Deposits are non-refundable once pre-production has begun, except as set out in section 7.

4. Client Responsibilities

The Client agrees to:

  • Provide accurate information and a clear brief
  • Arrange access to locations, people, and any permissions needed for filming on their premises
  • Supply logos, brand assets, and approvals within the agreed timeframes
  • Ensure that people appearing on camera are informed and, where required, have given consent

Delays caused by the Client may affect the delivery date and may result in additional charges.

5. Revisions and Approval

5.1. Each quote includes a set number of revision rounds: typically one round for small projects and two rounds for larger productions, unless the quote states otherwise.
5.2. A revision round means a single consolidated set of feedback from the Client. Changes to the agreed concept, script, or footage selection after approval, or additional rounds, are charged at our standard rate.
5.3. If the Client does not respond with feedback within [10] working days of receiving a draft, we may treat the work as approved.

6. Schedule and Delivery

6.1. Delivery dates are agreed in writing and are estimates dependent on timely Client feedback and approvals.
6.2. Final videos are delivered digitally in the formats listed in the quote.
6.3. We retain project files and raw footage for [12] months after delivery. After that, we are not obliged to keep or supply them. Raw footage is not included unless agreed in the quote.

7. Cancellation and Postponement

7.1. If the Client cancels or postpones a shoot with less than [48 hours’] notice, we may charge up to [50]% of the shoot day fee to cover committed crew and equipment.
7.2. If the Client cancels after work has begun, they will be invoiced for work completed to date and any non-recoverable costs (e.g. crew bookings, licensing, travel).
7.3. If we must cancel or reschedule due to illness, equipment failure, or circumstances beyond our control, we will offer a new date or a refund of payments made for work not yet delivered.

8.1. Filmeka retains copyright in all footage, edits, and deliverables until payment is received in full.
8.2. On full payment, we grant the Client a non-exclusive, perpetual licence to use the final delivered video for their own business and marketing purposes, in any media.
8.3. The licence does not include resale, sublicensing, or use of raw footage, unless agreed in writing.
8.4. Third-party elements (music, stock footage, fonts, graphics) are licensed under their own terms. Where we license these on the Client’s behalf, usage is limited to what the licence allows.

9. Portfolio and Promotional Use

Unless the Client tells us otherwise in writing before the project begins, Filmeka may use the finished work, clips, and behind-the-scenes material in our portfolio, website, social media, and promotional materials. We will not publish anything confidential or commercially sensitive that the Client has identified to us.

10. Equipment, Locations, and Safety

10.1. Filmeka is responsible for the care of its own equipment. The Client is responsible for providing a safe working environment at their premises.
10.2. Where drones are used, we operate in line with applicable Irish Aviation Authority and EU regulations. Drone filming may be postponed or cancelled due to weather, airspace restrictions, or safety concerns, without penalty to either party.

11. Liability

11.1. We will carry out our services with reasonable skill and care.
11.2. Our total liability in connection with any project is limited to the amount paid by the Client for that project.
11.3. We are not liable for indirect or consequential loss, including loss of profit or business.
11.4. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

12. Force Majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including severe weather, illness, accidents, power or network failures, public health restrictions, or government action.

13. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the project, except where disclosure is required by law.

14. Website Use

The content on this website, including text, images, and videos, belongs to Filmeka and may not be copied or reused without permission. We do not guarantee that the website will always be available or error-free. Information about how we handle your personal data is set out in our [Privacy Policy].

15. Changes to These Terms

We may update these terms from time to time. The version in force when a quote is accepted applies to that project.

16. Governing Law

These terms are governed by the laws of Ireland, and the Irish courts have exclusive jurisdiction over any dispute.
